FUNDING
The program receives $25 per misdemeanor, $50 per felony, and $200 per count for any sex-offense conviction. The assessment is automatically made in every case. The program receives
an annual VOCA grant.
ELIGIBILITY REQUIREMENTS
Reporting period: 72 hours
Filing period: 1 year
Exceptions: Good-cause exception construed
liberally, especially in cases involving
minors, domestic violence, sexual assault
or abuse
PROCEDURES
Case manager makes the initial determination of eligibility. If the claim is to be awarded, notice is sent to the claimant and to providers,
who are asked to send bills for evaluation and
payment.
Appeals: Claimant has 20 days to petition
the program director for reconsideration of any
award or order or, alternatively, 45 days to request a hearing with the commissioners of the
Industrial Commission. The claimant's final
appeal is through a motion for reconsideration to
the commission.
