Responding to the Executive Memorandum on Fairness in Law Enforcement: Department of Justice ProposalOn June 9, 1999, the President issued an executive memorandum to the Secretary of the Interior, the Attorney General, and the Secretary of the Treasury directing them "to design and implement a system to collect and report statistics relating to race, ethnicity, and gender for law enforcement activities in each department." The Departments of the Interior and the Treasury were directed to coordinate the preparation of their proposals with the Attorney General. On October 8, 1999, the Department of Justice submitted its proposal to the President. The Department of Justice proposal employs a two-part process. Part 1 focuses on nonsuspect-specific encounters by the Drug Enforcement Administration (DEA) and the Immigration and Naturalization Service (INS). During the field test, data will be collected on all persons encountered by DEA agents on up to 9 Operation Jetway sites, by INS inspectors at 3 international airports and 1 land border crossing, and by INS Border Patrol agents operating out of 3 stations including a fixed check-point within the United States. Part 2 focuses on persons arrested by all DOJ law enforcement agencies and persons prosecuted by U.S. attorneys.
