Planning Funding Sources
BJA: Edward Byrne Memorial State and Local Law Enforcement Block Grants
(Byrne Formula Grants). States may use formula funds to support a range
of activities that could have an effect on terrorism and domestic preparedness.
States may also request a waiver of the criminal justice improvement set-aside
requirement to use these reserved Byrne funds to respond to the
demands placed on criminal justice system components by the September 11 terrorist
attacks. Such funds are still subject to the terms and conditions of the Byrne
Formula Grant Program and may also be used for any and all of the following
purposes: developing and implementing anti-terrorism plans and training
programs, purchasing equipment for local law enforcement anti-terrorism projects,
improving community crime prevention and security, creating multijurisdictional
task forces in response to organized crime, facilitating interagency and intelligence
coordination, integrating criminal justice information systems, investigating
and prosecuting money laundering and cybercrime, and improving DNA identification
systems.
BJA: Local Law Enforcement Block Grants (LLEBG). LLEBG directly
funds units of local government to support projects that improve public safety.
Planning Funding Hypotheticals
Can OJP funds be used to prepare for the security of the arena that
will host the 2002 NCAA Men's Championship Game?
Yes, under BJA Byrne Formula Grant Program Purpose Area #7b, if this is part
of an implementation of an anti-terrorism plan for a designated facility. Also
see BJA LLEBG Program Purpose Area #1, for the overtime pay of law enforcement
officers, and LLEBG Program Purpose Area #2, for the purpose of enhancing security.

Can OJP funds be used by a state agency to coordinate state assistance
to local authorities and nongovernmental organizations to prepare for and respond
to terrorist threats or attacks within the state?
Yes, under the BJA Byrne Formula Grant Program Purpose Area #7b, if this is
part of an implementation of an anti-terrorism plan for a designated facility.
Also see ODP, which presently provides an integrated suite of training, exercise,
technical assistance, and grant equipment programs to all 50 states, the 5 U.S.
territories, and the District of Columbia to enhance weapons-of-mass-destruction
(WMD) terrorism preparedness and response capabilities nationwide.
Can OJP funds be used hire a prosecutor whose duties would include
reviewing and revising regulations and statutes applicable to the investigation
and prosecution of alleged terrorists?
Yes, under BJA Byrne Formula Grant Program Purpose Areas #2 and #16; however,
federal funds may not be used for lobbying.
Can OJP funds be used by a state agency to plan for a mass medical
emergency, including the implementation of an appropriate medical response?
Yes, under BJA Byrne Formula Grant Program Purpose Areas #7b and #26. Also
see ODP, which is responsible for enhancing the capacity of state and local
jurisdictions to respond to and mitigate the consequences of incidents of domestic
terrorism. ODP, in partnership with the U.S. Department of Health and Human
Services, provides training, exercises, and planning for the medical response
community. ODP also provides a Hospital Emergency Management Course that covers
concepts and implications of WMD terrorism for planners and an Emergency Medical
Services Course to assist the medical community in operations and planning for
this type of incident. ODP works in conjunction with all levels of the medical
community to facilitate the appropriate medical response to WMD terrorism. See

Can OJP funds be used to develop a plan for mass vaccinations to protect
against deadly biological agents?
Yes, under the BJA Byrne Formula Grant Program Purpose Area #26 and BJA LLEBG
Program Purpose Area #1, plans may be developed to protect law enforcement officers
and other emergency response personnel.
Can OJP funds be used to develop and implement plans and preparations
for ensuring the continuity of the state government in the event of a terrorist
attack on one or more of its branches?
Yes, under BJA LLEBG Program Purpose Area #2, for planning purposes and operational
response in the event of such an attack or threat. Also see BJA Byrne Formula
Grant Program Purpose Areas #7b and #26. Also see ODP. Due to the importance
of maintaining continuity of government (COG) during WMD terrorist incidents,
COG has been incorporated as a critical component of all ODP programs including
training courses, exercises, and technical assistance. ODP programs also are
directed at a broad spectrum of state and local emergency responders, including
firefighters, HazMat, emergency medical services, emergency management agencies,
law enforcement, public works, health and medical services, and public officials.
The purpose of targeting this spectrum is to provide coverage at all levels
within the emergency response community to further ensure the continuity of
state and local governments in the event of a terrorist attack.
Can OJP funds be used to help school teachers, administrators, and
other school personnel plan for a terrorist attack?
Yes, under BJA LLEBG Program Purpose Area #2 and BJA Byrne Formula Grant Program
Purpose Areas #7b and #26. Also see ODP. The role of ODP is to enhance state
and local governments' ability to respond to WMD terrorism. ODP's technical
assistance program provides assistance and planning support to all aspects of
WMD terrorism preparedness planning.
Can OJP funds be used to review and revise plans to ensure that the
appropriate security measures are in place at major public and private recreational facilities within the state?
Yes, under BJA LLEBG Program Purpose Area #2 and BJA Byrne Formula Grant Program
Purpose Areas #7b and #26. Also see ODP.
Can OJP funds be used to help communities develop a long-range
strategic plan for responding to the needs of terrorism victims before
an event occurs?
Yes, through OVC's Criminal Crisis Response Initiative (CCRI). CCRI is a community-based
assessment and planning process that assists communities in the design and implementation
of a long-range strategic plan based on a formal collaborative of victim service
providers. Note: Preplanning activities are not authorized under grants
from OVC's Anti-Terrorism and Emergency Assistance Program for Terrorism and
