LLEBG Provisions - Public Safety Officers' Health Benefits (PSOHB)
As part of the Local Law Enforcement Block Grant (LLEBG) application process, each eligible jurisdiction is required to make certain assurances and certifications via the on-line LLEBG Grants Management System (GMS). The Public Safety Officers' Health Benefits (PSOHB) provision is one such certification.
PSOHB compliance is self-certifying and persons completing the LLEBG applications should verify compliance with their jurisdiction's human resource officer or general counsel. The PSOHB certification should reflect an applicant jurisdiction's compliance or non-compliance, as of the date of the application. In accordance with the statute, applicant jurisdictions that are not in compliance with the PSOHB provision, at the time of the application, are still eligible to receive LLEBG funding from BJA, but the Federal award amount will be reduced by 10%.
Prior to certifying to PSOHB compliance, each eligible jurisdiction should carefully review the following to ensure that the process used by the jurisdiction meets the requirements of the PSOHB provision:
Copies of general orders, State law, local law, policies, rules and/or regulations which indicate that the definition(s) for a public safety officer, law enforcement officer, firefighter, and public agency used by your jurisdiction are consistent with the definitions for those terms as outlined in section 1204 of title I of the Omnibus Crime Control and Safe Streets Act of 1968, as amended, codified at 42 U.S.C. ยง3796b.
Copies of State statutory law, State case law, local law, or established written policies which define "injury suffered as a direct result of a personal injury sustained in the line of duty while responding to an emergency situation or a hot pursuit." In addition, copies of any of these authorities which contain the definition for the terms "emergency situation" and "hot pursuit" should be reviewed.
Any materials related to your jurisdiction's written procedures or process for reviewing these "line of duty" injuries.
Any materials which document that your jurisdiction provides the same or better level of health care insurance benefits at the time of retirement or separation from duty, as a the public safety officer received while on active duty.
