FY 2004 LLEBG - Prohibited Uses of Funds
LLEBG funds are not to be used to purchase, lease, rent, or acquire
- tanks or armored vehicles,
- fixed-wing aircraft,
- limousines,
- real estate,
- yachts,
- consultants,
- vehicles not used primarily for law enforcement, or
- construction of new facilities
Supplanting
Grant funds, which include matching funds, may not be used to replace state or local funds that would, in the absence of federal assistance, be available or forthcoming for law enforcement. Instead, grant funds must be used to increase the total amount of such other funds the grantee agency uses.
A grant recipient may not use federal grant funds to defray any costs that the recipient is already obligated to pay. For example, if a grantee, prior to applying to participate in the grant program, had committed to purchase 10 new computers for crime analysis, then the grantee must purchase those 10 computers in addition to any computers requested for the grant program.
Renovations
Renovations of facilities may be permitted when specifically approved by BJA. A local jurisdiction must formally request prior approval via the "correspondence" section of the LLEBG GMS. However, renovation costs may not exceed 10% of the total federal funds used for a given LLEBG funded project.
For example, a renovation project costs $100,000, the total federal funds the program office may allow to be spent on such a project cannot exceed $10,000. The amount allocated to a purpose area has no impact on the approved amount.
